Terms and conditions

  • Terms and Conditions of Sale

These Terms and Conditions govern the use of the website and the purchase of products sold under the CRISTINA BARROS brand, and are addressed to end consumers habitually resident in the countries identified in section 2. Placing an order implies full acceptance of these Terms and Conditions.

    1. Seller identification

The CRISTINA BARROS brand is marketed by BLACKSPIDER, LDA., a company with tax identification number (NIF) 507116917, registered office at R. Armindo da Costa Azevedo Junior, 129, 4785-099 Trofa, Portugal, contact customerservice@cristinabarros.com, phone +351 252 411 234.

    2. Scope of application

These conditions apply to purchases made through the CRISTINA BARROS online store by end consumers, acting for purposes outside their trade, business or profession, who are habitually resident and have a billing and delivery address in one of the following countries ("Served Markets"): Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, the Czech Republic, Romania and Sweden, the United Kingdom and the United States of America.

CRISTINA BARROS does not sell to Portugal. The website can be viewed from mainland Portugal, the Autonomous Region of the Azores and the Autonomous Region of Madeira, but the checkout process does not allow orders to be completed with a billing and/or delivery address in Portuguese territory.

For consumers resident in the above-listed EU Member States, the consumer-protection provisions arising from Directive 2011/83/EU and Directive (EU) 2019/771 apply, as transposed into the national law of the consumer's country of residence, without prejudice to the contract otherwise being governed by Portuguese law under section 22.

For consumers resident in the United Kingdom, the consumer-protection provisions in force in the United Kingdom apply, in particular the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

For consumers resident in the United States of America, the EU statutory right of withdrawal set out in section 11 does not apply; voluntary returns are instead governed by section 11-A.

Customers wishing to purchase on behalf of a business or for professional purposes should contact Customer Service beforehand, as the consumer-protection provisions set out here do not apply to such purchases.

    3. Products

Products are described as accurately as possible, including their characteristics, composition and images. Minor colour variations resulting from the display settings of the device used do not constitute a lack of conformity. Product availability is subject to stock at the time of order.

    4. Prices

All prices shown on the website are expressed in euros (€) and include applicable taxes under the tax legislation in force for each destination. Shipping costs, where applicable, are shown separately before the purchase is completed, as set out in section 9.

For customers with a billing and/or delivery address in the United Kingdom or the United States of America, the order amount is processed in euros (EUR); the exact amount charged in local currency (GBP or USD) depends on the exchange rate and any conversion fees applied by the customer's card issuer or bank, which are not the responsibility of CRISTINA BARROS.

Prices may be changed at any time without prior notice, without affecting orders already confirmed and paid for.

    5. Customer account

Customers may place orders with or without registering an account. If an account is registered, the customer is responsible for the accuracy of the information provided and for keeping their login credentials confidential.

    6. Order process

An order is confirmed by means of a confirmation e-mail sent once payment has been accepted. The contract is deemed concluded at that time, under the consumer-protection legislation applicable in the customer's country of residence.

    7. Payment methods

The following payment methods are available, processed through the contracted payment platform: credit/debit card and bank transfer. The availability of each payment method may vary depending on the billing or delivery country. Orders are only processed once payment has been confirmed by the payment processor.

    8. Delivery and timeframes

Deliveries are made to the following destinations: Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, the Czech Republic, Romania and Sweden, the United Kingdom and the United States of America.

Orders are shipped via UPS, DPD or NACEX, depending on availability for the destination and the option selected by the customer.

Estimated delivery time, from payment confirmation, is 8 to 14 business days for all Served Markets.

The timeframes indicated are estimates and may be longer for reasons not attributable to CRISTINA BARROS, including carrier delays, customs procedures or force majeure.

If delivery is not made within the agreed timeframe, the customer must give CRISTINA BARROS notice to deliver within a further reasonable period.

    9. Shipping costs

European Union (Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, the Czech Republic, Romania and Sweden): free shipping for orders of €500 or more. Below that amount: €16.95.

United Kingdom: free shipping for orders of €500 or more. Below that amount: €16.95.

United States of America: free shipping for orders of €1,000 or more. Below that amount: €40.

Applicable shipping costs are always shown to the customer before the order is finally confirmed.

    10. Customs duties and taxes

Orders destined for the United Kingdom and the United States of America may be subject to customs duties, import taxes or administrative fees charged by local authorities, which are the customer's responsibility and are not included in the order price or shipping costs. Orders to the other Served Markets, being EU Member States, are not subject to customs duties.

    11. Right of withdrawal

This section applies to consumers resident in EU Member States and in the United Kingdom. For consumers resident in the United States of America, section 11-A applies instead.

The consumer has 14 calendar days, from physical receipt of the product(s), to exercise the right of withdrawal, without needing to give any reason and without incurring costs other than those set out in section 12, under the national law applicable in their country of residence (in Portugal, Decree-Law No. 24/2014 of 14 February).

To exercise this right, the customer must give unambiguous notice of their decision via customerservice@cristinabarros.com, and then has a further 14 days from that notice to physically return the product(s).

11-A. Voluntary returns for customers in the United States of America

Although the statutory right of withdrawal in section 11 does not legally apply to consumers resident in the United States of America, CRISTINA BARROS grants, on a voluntary, commercial basis, a 14 calendar-day period after receipt of the order to return items, under the conditions set out in sections 12 to 15, with the necessary adaptations. This voluntary return policy does not constitute the exercise of a legal right and may be changed or discontinued by CRISTINA BARROS at any time, without retroactive effect on orders already confirmed.

    12. Returning products

Products must be returned in the condition in which they were received, with original tags and packaging, showing no signs of use, and accompanied by the invoice or proof of purchase. Return shipping costs are borne by the customer, except in the case of a defective or incorrectly delivered product.

    13. Exchanges

CRISTINA BARROS does not process direct exchanges. A customer who wants a different product (size, colour or model) must return the original product under section 12 and place a new order.

    14. Refunds

Once the returned product has been received and inspected, the refund is processed within a maximum of 14 calendar days, using the same payment method as the original purchase, unless otherwise expressly agreed with the customer. Original shipping costs are only refunded in the cases required by law.

    15. Exceptions to the right of withdrawal

The following are excluded from the right of withdrawal, under the consumer-protection legislation applicable in the country of residence (in the EU, Article 16 of Directive 2011/83/EU; in the UK, the Consumer Contracts Regulations 2013): personalised or custom-made products; products that, for hygiene reasons, have been unsealed after delivery; and any other statutory exceptions.

    16. Damaged, incorrect or missing items

If an item is received damaged, incorrect or missing, the customer must contact customerservice@cristinabarros.com within 48 hours of receipt, with photographs of the product and packaging, so that CRISTINA BARROS can arrange a replacement, repair or refund, at no additional cost to the customer.

    17. Statutory guarantee of conformity

For consumers resident in EU Member States, the statutory guarantee of conformity under Directive (EU) 2019/771 applies, as transposed into the national law of the consumer's country of residence (in Portugal, Decree-Law No. 84/2021 of 18 October). Under the general terms of this regime, the trader is liable for any lack of conformity existing at the time of delivery that becomes apparent within a minimum period of two years from that date, and longer periods may apply under the applicable national law.

For consumers resident in the United Kingdom, the statutory guarantee under the Consumer Rights Act 2015 applies, within the terms and timeframes set out therein.

For consumers resident in the United States of America, implied warranties may apply under applicable state law (in particular, the Uniform Commercial Code), without prejudice to any commercial warranties offered by CRISTINA BARROS.

In all cases, to exercise the rights set out here, the customer should contact customerservice@cristinabarros.com.

    18. Intellectual property

All website content (text, images, logos, trademarks and other elements) is the property of BLACKSPIDER, LDA. or its third-party licensors and is protected under applicable intellectual property law. Unauthorised reproduction, distribution or use of such content is prohibited.

    19. Complaints and the Portuguese Electronic Complaints Book

Customers may submit complaints via customerservice@cristinabarros.com or by phone at +351 252 411 234.

Consumers resident in Portugal who wish to submit a complaint about their browsing experience on the website may use the Electronic Complaints Book (Livro de Reclamações Eletrónico), available at www.livroreclamacoes.pt, under Decree-Law No. 156/2005 of 15 September, as amended.

    20. Alternative dispute resolution

If a consumer dispute is not resolved directly with CRISTINA BARROS, an EU-resident consumer may refer the matter to a competent alternative dispute resolution (ADR) entity in their country of residence.

Consumers resident in the United Kingdom may contact the Citizens Advice Consumer Service or their local Trading Standards office for information and guidance on dispute resolution.

There is no equivalent, general-purpose alternative consumer dispute-resolution body for the United States of America; US-resident consumers wishing to file a complaint may contact their state's consumer protection authority.

    21. Personal data protection

The processing of customers' personal data is governed by the Privacy Policy available on the website, which contains specific provisions applicable to data subjects in the United Kingdom and the United States of America.

    22. Governing law and jurisdiction

These Terms and Conditions are governed by Portuguese law.

Without prejudice to the foregoing, consumers resident in other EU Member States always benefit from the protection afforded by the mandatory consumer-protection provisions of their country of residence that cannot be derogated from by agreement, under Article 6 of Regulation (EC) No. 593/2008 (Rome I), and may bring proceedings against CRISTINA BARROS either before the Portuguese courts or before the courts of their own country of residence, under Regulation (EU) No. 1215/2012 (Brussels I Recast).

Consumers resident in the United Kingdom may likewise bring proceedings before the courts of their country of residence to enforce rights conferred by mandatory consumer-protection provisions applicable in the United Kingdom.

For consumers resident in the United States of America, any disputes arising from this contract will be submitted to the Portuguese courts, without prejudice to any mandatory rights that cannot be excluded by agreement under applicable law.

    23. Changes to these Terms and Conditions

CRISTINA BARROS reserves the right to change these Terms and Conditions at any time; the version in force at the date of the order will apply.
